Deadlines & Statutes That Affect Your Case

Every type of case has its own filing deadline. Miss it and you can lose your rights entirely — which is why talking to an attorney early matters.

O.C.G.A. § 9-3-33

2-Year Personal Injury Deadline

Most Georgia injury lawsuits must be filed within two years of the date of injury. Wrongful-death and certain claims have their own clocks. Waiting can permanently bar your claim.

O.C.G.A. § 51-12-33

Modified Comparative Negligence (50% Bar)

You can still recover even if partly at fault — but your award is reduced by your share of fault, and you recover nothing if you are 50% or more responsible. Insurers exploit this; we fight it.

O.C.G.A. § 34-9 (Workers’ Comp Act)

1-Year Workers’ Comp Filing

Report a job injury to your employer right away, and generally file a workers’ comp claim (Form WC-14) within one year. Benefits include medical care and weekly wage replacement.

Criminal Statutes of Limitation

Georgia sets time limits on prosecutions — commonly two years for most misdemeanors and four years for many felonies, with serious crimes having longer or no limit. Early defense counsel is critical.
